Terms & Conditions
All shipment/delivery orders placed with Century Messenger, its employees and agents shall comply with the terms and conditions set forth herein which no agent or employee of Century Messenger may alter. Customer (ie. Shipper) also agrees to these terms and conditions on behalf of any third party with interest in the shipment. By placing a delivery order with Century Messenger you also agree that you are authorized to place shipment orders on behalf of Shipper and bind Shipper to these terms and conditions for all shipment orders placed by you through Century Messenger.
Services
Century Messenger will provide transportation services as requested by Shipper and will arrange for air and surface transportation as required. Century Messenger reserves the right to use agents or other third parties to fulfill these services.
Right of Refusal
Century Messenger reserves the right to refuse or reject any shipment and may do so in its sole discretion and without liability. Century Messenger may exercise this right at any time, and includes situations (among others) when a shipment may cause damage to or delay other shipments, property or personnel; is likely to sustain damage or loss in transit due to improper packaging; contains prohibited items; the account of Shipper is not in good standing; or when acceptance of a shipment may jeopardize Century Messenger's ability to provide service to other customers.
Customer Responsibility
Customers are responsible for accurately providing shipping information, package dimensions and weights, pickup & delivery locations and times. Century Messenger will not be liable for customer omissions, improper or insufficient packaging, securing, marking or addressing. Delivery rates are subject to recalculation if package size and weights are inaccurately provided by the customer. Additional charges may apply if pickup or delivery addresses provided are incorrect and delivery routes are delayed or packages have to be re-delivered. Additional charges may also apply if package arrives at delivery address but recipient/receiver is not present to accept the packages. In the later case, if delivery signature is required, customers are responsible for all delivery costs, as well as any costs incurred in returning packages to the customer and/or storage related costs pending re-delivery. If signature is not required, packages are then considered delivered and Century Messenger, its employees, agents, subcontractors and affiliates are not responsible for any lost or damage at any time after delivery. If packages are not ready for pickup at the time scheduled, Century Messenger may charge an additional fee for the delay. Signature of recipient/receiver on Century Messenger's Waybill represents items delivered and received in good faith and condition.
Package contents must comply with all applicable local, state and federal laws, including those governing packing, marking and labeling for all shipments. All shipments are subject to inspection by Century Messenger or government officials at its discretion. Century Messenger does not deliver Hazardous Materials (HM) or Dangerous Goods (DG).
Limitations on Liability
Century Messenger's liability for any loss, damage or delay to, or involving, a domestic shipment (which shall include all documents or packages consigned under a single Waybill) is limited to the lesser of $100.00 (U.S) or the actual value of the item unless customer paid an additional fee for a higher declare value. Declare values for items of "extraordinary value", including, but not limited to items such as artwork, jewelry, furs, precious metals and negotiable financial instruments requires approval. Any exclusion or limitation of liability applicable to Century Messener shall apply to Century Messenger's agents, subcontractors and employees and to any person whose aircraft or equipment is used in the transportation of the shipment.
Century Messenger will not be liable for loss, damage or delay caused by any circumstances beyond the control of Century Messenger including, but not limited to, weather, governmental action, mechanical delays, acts of God, strikes or labor disturbances, civil commotion, war, terrorism, fuel shortages, any act or default of Shipper or consignee, inherent vice or defect of the shipment, or violation by Shipper or consignee of any of these Terms and Conditions. Century Messenger will not be liable for any damage, whether direct, indirect, compensatory, exemplary, incidental, punitive, special or consequential including, but not limited to, loss of income or profits whether or not Century Messenger had knowledge that such damages might be incurred.
Contents and information on Centurymessenger.com will be updated regularly. Although we have taken reasonable precautions to ensure all information is accurate and up-to-date, Century Messenger will not be liable for any typographical or functional errors on its website.
Filing a Claim:
All claims must be mailed in writing within 7 days of the date of delivery and received by Century Messenger at: 683 Osprey Avenue, Kelowna, BC V1Y 5A7. Century Messenger is not obligated to act on any claim until Shipper has paid all charges related to such shipment. The amount claimed cannot be deducted from outstanding charges related to shipments transported under this or any other Waybill. Shipper is responsible for providing adequate documentation to support the actual or declared value of the loss. Any damaged shipment and its original packing material must be made available to Century Messenger for inspection at the delivery location shown on the Waybill or through other means. Customers are responsible for proving the actual loss or damage.
Choice of Law
In the case of a dispute or legal action, Customer agree that any action will be filed and litigated in Kelowna, British Columbia. Customer also agrees to arbitration rather than legal actions through the courts and to have Expedia Courier provide an arbitrator acceptable to both parties.
